How Rideshare Insurance Works in Virginia
In Virginia, the insurance available after an Uber or Lyft crash usually depends on what the rideshare driver was doing in the app at the time of the crash.
If the Driver Was Logged Out
If the driver was not logged into the Uber or Lyft app, the rideshare company’s insurance usually does not apply. The driver’s personal auto policy may be the first policy to review, along with any other insurance that may apply to the crash.
If the Driver Was Logged In and Waiting
If the driver was logged into the app and available for rides, but had not accepted a ride request, Virginia requires Transportation Network Company (TNC) insurance with at least:
- $50,000 for injury or death to one person.
- $100,000 for injury or death to more than one person in one crash.
- $25,000 for property damage.
This coverage may come from the driver’s TNC policy, the rideshare company’s policy, or both. If the injuries are serious, we look for every available policy.
If the Driver Accepted a Ride
Once the driver accepts a ride request, Virginia requires at least $1 million in primary liability coverage. That coverage applies while the driver is on the way to pick up the passenger and while the passenger is in the vehicle.
