My associate took a call on a new personal injury case yesterday. In speaking with the potential client, he got a history of a prior accident and claim. In that claim there were a relatively low amount of medical bills that upset the lawyer because it made the value of the claim less.
The lawyer had a solution and bragged to the client that he could send him to Dr. XX (actually a well known orthopedic surgeon in Washington, D.C.) who could run some "trumped up" [his EXACT words] bills at $900 per half hour.
There are some in our profession who have done more, through crap like this and through tacky advertising, to shoot the rest of us in the foot than any outside "tort reformer" has done.
We address this situation in two of our book, The Truth About Lawyer Advertising and Five Deadly Sins That Can Wreck Your Virginia Accident Case.
