Hi, this is Ben Glass. I'm a Medical Malpractice Attorney here in Virginia. I see that former Pennsylvania Senator, Rick Santorum, is running for president. He's probably a very smart guy, there's a lot of things I probably agree with, but what you want to know is that -- on the issue of tort reform, he's a real hypocrite.

Remember, tort reform laws are those laws which seek to limit your access to a court, to a jury and to full justice even before we know what happened. So a guy goes out, drinks 10 beers and crashes into your family, tort reform law say, "We're going to decide before any of that happens, how much you can recover?" A doctor operates, takes off the wrong leg, tort reform will protect the doctor from lawsuit against him.

Well, what I find happens a lot is people who advocate for tort reform, when it happens to their -- someone in their family all of a sudden, they're not really a tort reform advocate. That's what happened to his family. His wife was injured by a doctor here in Virginia. She sued that doctor for $500,000.00 here in Virginia. She asked the court to declare that the Virginia's tort reform wouldn't apply to her. The jury awarded her a large sum of money and then defending that verdict. She told the judge that the jury is the ruler of the damages, not the jury's decision on damages should be adhered to. That's totally different from the position that her husband takes in politics and is very, very hypocritical.

And here's the worst part, it is in the Virginia litigation. He tried  to keep all of these out of the public eye. So they knew that it wouldn't make good sense to have him advocating for limits on malpractice damages in public, but having his wife sue a doctor, so they tried to have the whole file put under seal, the judge here in Virginia would have none of that. I've got the court record for you. You can see for yourself exactly what went on. Just fill out your name and email address below and I'll email the package to you.
