Tell Us Your Story

From time to time we will be asked to give a second opinion for a potential client who is currently represented by another Virginia attorney. We rarely accept cases that have been handled by another attorney but we are happy to give you a second opinion and some advice regarding your claim. Usually, if you are having a problem with your attorney it is a failure of communication on either your part or the attorney's part. We will be happy to coach you on how to improve your communication.

If you would like us to give you a second opinion regarding your claim, and that claim arose in Virginia, and you have hired a Virginia personal injury or car accident attorney, then this is the email you need to send to your attorney first:

Dear [name of paralegal or attorney]:

I wanted to touch base with you to see where we are specifically in my case. As you know we are coming up on the XX year anniversary of my car accident.  I want to make sure that we are on the same page moving forward with my car accident case.

It would be very helpful if you could email me back, answering the following questions and providing the documents that I have listed below. Thank you so much for your assistance.

1. Who is the lawyer in charge of my case? How do I contact this person?

2. What is that lawyer's current evaluation of my case?

3. Has a trial date been set in my case? If not, can we do that?

4. Please attach to your response PDFs of the following documents:

a. The complaint filed on my behalf.

b. The answer or any other response filed by the defendant.

c. If there have been any motions in my case please attach those (as well as any response to the motions.)

d. Please send me any discovery responses that have been filed on my behalf (I am sorry that I cannot remember everything that I have done in the case)

e. Please send me the responses to any discovery requests that have been filed by the defendant.

5. Please tell me the amount of insurance available to cover the injuries I sustained in my accident.

6. Please email me copies of all of the medical records that you have collected in my case. I have a lot of records and I want to make sure that we are all of the same page regarding my claim.

7. Please send me a copy of the fee agreement I signed. Again I apologize but I have misplaced my copy.

I very much appreciate your help in this case.

NOTE: if you can get that information and put it together in a short set of PDF documents will be happy to review it for you. This does not make us your lawyer for your claim. This does not mean that we will represent you. In most cases, your best course of action is to re-establish a good line of communication with your attorney.
