This was a wild DUI case. Our client was traveling home when they were struck from behind at a high rate of speed by a drunk driver – the drunk driver was extremely intoxicated and recorded a .15 blood alcohol concentration level (BAC) at the scene (almost twice the legal limit!). The force from the impact was so great that our client’s car spun around, hurtled off the road, and flipped over – luckily, our client and his wife were not severely injured.

Our client (a decorated military veteran) instantly jumped into action and safely got his wife out of their wrecked vehicle. Then, in what can only be described as a selfless act of heroism, our client ran to the defendant's vehicle and helped them get to safety. However, instead of a thank you, the passenger in the defendant’s car approached our client and struck him in the face – the passenger was charged with assault and domestic violence.

As a result of the accident, our client required one staple in his head for a 1.5 cm laceration and had a low-grade surface tear of the distal fibers of the supraspinatus, moderate osteoarthritic changes in the glenohumeral joints, and moderate AC joint degeneration (shoulder tear). He also suffered from psychological trauma (PTSD) as a result of the crash and had trouble performing simple tasks such as driving in his neighborhood at a low rate of speed.

This case was a good example of the importance of having good underinsured/uninsured motorist coverage because the defendant did not have any liability insurance. Surprisingly, our client was able to recover eight times the medical costs in the case which was incredible.
