Is It True that You Can't Use Your Own Health Insurance After a Car Accident?

If you've been in a car accident and are going to a chiropractor or medical doctor, you might be told that "your health insurance doesn't cover car accidents, you can't submit your bills to them."

It's simply not true.

Why would anyone say this? There are two reasons. First, they might be honestly ignorant of insurance and contract law. Someone might have told them this at one time and since they are health care providers and not lawyers, they don't know any better. They are still wrong.

The second (and more nefarious) reason might be that they know that if you bill your health insurance company, and they are a participating provider, they will only be paid about 60% of their bill. (That's the deal they made with your insurance company when they agreed to participate in the plan.)

If they can convince you to not bill your health insurance company but to use your auto insurance "medpay" or pay cash or wait till the end of the case to get paid, they believe they can get paid 100% of the bill.

Either way they are wrong. If you have been injured in a car accident and you have health insurance and your doctor or chiropractor participates with the insurance company you should always use your health insurance first. (Yes, you might have to reimburse your health insurance if you settle your case but you will be be far better off in the long run.)
