Local media is reporting that a huge tree crushed and killed a Virginia driver when it fell onto a major road near the northern city of Great Falls Tuesday evening. Albert Carl Roeth III, 64, was the only passenger in the car, a 2008 Mercedes CL600.

This happens more times than any one of us wants to know and the question often arises whether the property own is in any way responsible for checking on and removing these potentiall harmful trees.

The Supreme Court of Virginia recently ruled in a very important case which answerd this question: Is a property owner in Virginia responsible when a dead and obviously decayed tree falls and hurts or kills someone?

The answer may surpise most people.
