I've been saying for years that most of these group long term disability policies that we see here in Virginia are worth little more than the paper they are written on. With broad discretion afforded the insurance companies making the decisions and limited damages for those who end up suing the insurance company (you get back what they owed you in the first place) it is becoming harder and harder to be treated fairly.

The better option is to go out while you are healthy and get a good individual policy.

More expensive, yes. Better protection though.

Frank Darras, one of the top insurance lawyers in the country, reinforces this view in a recent article where he points out that the recession has only made it worse for claimants. I recommend reading the Darras article on the perils of ERISA long term disability policies and then shopping for an individual policy if you can afford it.
