One of the Five Deadly Sins--the Lawyer Refers the Client to a Doctor
Some folks don't really believe us when we write, in Five Deadly Sins That Can Wreck Your Virginia Car Accident Case, that getting a referal from your lawyer to your doctor is a bad thing.
It was for a plaintiff in a recent Virginia case involving a car wreck.
The judge found that the lawyer made the referal and then later failed to file the correct report with the court.
The judge would not let the doctor testify.
That's really bad news.

Ben warned about this mistake in his book several years ago. When a lawyer refers an injured client to a treatment provider, be that provider a medical doctor, chiropractor, physiotherapist or whatever, the circumstantial guarantees of the trustworthiness of the expert's opinion are seen by the courts to be lacking. A trap for unweary clients that saavy personal injury attorneys know to avoid.
