If you have been denied long-term disability insurance benefits one of the first things an attorney is going to want to know is whether your claim is governed by ERISA. Most attorneys will not touch an ERISA case because of its Byzantine rules and procedures.
If you got your long term disability policy through your employer there is a high likelihood that it is an ERISA policy. Some school or church plans do not apply.
It is critical that your attorney know what do to with an ERISA policy because the rules and procedures for a non-ERISA and an ERISA governed policy are completely different.
