This is really an incredible opinion. In a case where the Commonwealth of Virginia charged Wolfe with capital murder, in intentionally withheld a critical document from Wolfe's defense team that would have seriously impeached the state's one witness who connected Wofle to the alleged murder for hire scheme.
The Court of Appeals called the Prince William prosecutor's explanation for deliberately withholding the document that sent Wolfe to death row for 11 years "flabbergasting."
Quoting with approval from the Federal District Court that lambased Prince William Prosecutor Ebert, the court said Ebert's actions "deprived Wolfe of any substantial defense in a case where his life would rest on the jury's verdict."
The Court of Appeals called Ebert's conduct "abhorrent to the judicial process."
