Expungement permitted for marijuana charge that was amended to reckless driving.

Prior to this recent decision, any charge that was amended to a different charge was simply not expungeable under Va. law.  However, recently, the Va. Supreme Court held that a marijuana charge that was amended to a reckless driving was expungeable as it was "otherwise dismissed."  Traditionally, the term otherwise dismissed was very limited and precluded charges that were even dismissed, such as deferred findings.
