On this section of Just Ask Ben Glass, Melissa in Arlington is asking about a drunk driver who hit a cyclist on the trail. The question is whether or not there is a claim even though the act was not on a highway. Ben Glass explains that the insurance of the lady who hit the cyclist will cover the health costs for this cyclist. However, if she did not have insurance or inadequate coverage, the cyclist would have been covered by his own health insurance. Virginia is one of the few states that allow people to not have car insurance, which could have terrible consequences for those who are hit by an uninsured driver. If you have been a victim of an uninsured driver, contact us to find out your options.
