We represent a very nice family for a car accident that took place in the Tidewater area of Virginia. The accident was captured on video. A young, newly licensed driver is seen racing through a stop sign, hitting a car broadside and causing one of its occupants to be catastrophically injured when he was ejected from the car.
The young girl's family had one of those crummy $100,000 policies so our client's Chubb Insurance policy takes over a lot of the defense. Mind you, this is the insurance company to which our clients have been paying a hefty premium for a "deluxe" policy over the years.
Here's what Chubb says in litigation.
We think you contributed to the accident. (The video shows this to be impossible and Chubb knows it)
We want your driving record - go get it. (Our client's driving record, which is excellent, is totally irrelevant to this case)
We don't think you or the other passengers in the car are as hurt as you say you are. (Remember, this is their own insurance company - the company with which they have a long time, expensive relationship!
They'll be thinking about that when renewal time comes. Believe me.
