“Baby” DUIs in Virginia

As you probably know, it is illegal for anyone under the age of 21 to possess alcohol.  Given this, it is easy to understand that it is an additional offense for a person under 21 to have drunk any amount of alcohol and drive.  This offense is colloquially referred to as a “baby” DWI.

Baby DWIs are similar to traditional DWIs in that they are Class I misdemeanors.  They also mandate a one year forfeiture of driver’s license.  However, offenders are guilty of a baby DWI if they have a BAC of only .02 or above.  There is also a mandatory minimum punishment of $500 and 50 hours of community service.
